TERMS
& CONDITIONS FOR ORDERING AND UK DELIVERY DURING A WEEKDAY
(Monday to Friday)

PLEASE
READ THESE CONDITIONS THOROUGHLY
GENERAL
- The
operators of "Balloon in a Box.co.uk", Net Art Ltd
(hereafter refereed to as NA) offer to supply the balloon(s)
selected by the customer. All helium filled balloons will be
secured to a weight using ribbon. The balloon is dispatched
using a box that is considered suitable for delivery by the
Royal
Mail®. If an additional gift is supplied this will be dispatched
with the balloon.
- The balloon
sent will be that chosen by the customer. NA reserve the right
to substitute the chosen balloon with another of similar wording
or meaning, if it is out of stock or no longer manufactured.
Under such circumstances all reasonable attempts will be made
to notify the customer to notify them of this change.
- At the
time of ordering the Customer must provide
a
correct daytime telephone number and e-mail address. Failure
to provide this may result in the order not being sent.
- NA cannot
be held responsible for incorrect information supplied
by the customer. Prior to payment the Customer should check
that all the information submitted is accurate and complete.
NA will not be held responsible or liable for failed or late
deliveries due to incorrect information being provided by the
Customer.
- By submission
of the order the customer accepts these terms and conditions
and authorises NA to take payment for the product selected on
the order form. Orders made using this web site will normally
result in the customer's credit card being debited within 24
hours of the order being placed.
- If payment
is being made by cheque the balloon will not be dispatched until
the cheque has been cleared by NA's bank. Therefore if paying
by cheque please ensure that your order is received by NA at
least ten days before the due date of delivery. If payment is
being made through PayBox you will receive an email from Paybox
confirming payment and then you will receive an email from us
confirming your order. If payment is rejected by PayBox you
will not receive an email confirming your order.
- If NA
are unable to process a Customer's order the Customer will be
notified
as soon as possible by e-mail for orders originating from this
web site or by telephone/ fax for orders placed using the post
or fax. If NA are unable to contact the Customer by e-mail,
telephone or fax, the Customer will be contacted by post.
- NA cannot
guarantee the time period that
the balloon will stay inflated for, but the average time for
an 18 inch balloon, is circa 7-10 days. Please note that the
Royal Mail® does transport some of its post by air within
the UK and that this may result in loss of some helium from
the balloon. Unfortunately NA are unable to prevent this from
occurring.
- For orders
placed using a credit card all charges incurred by NA will be
billed to the Customer's card. If the charge is refused NA,
without notice, reserve the right to cancel the order and take
whatever steps is necessary to recover the debt and any associated
costs incurred. All such costs will be charged to the Customer.
- NA reserve
the right not to process an order if it is believed by NA that
the credit card transaction has been made
fraudulently, under such circumstances the customer will be
contacted to obtain further information concerning details of
the credit card holder.
DELIVERY CONDITIONS
-
NA use a next day Royal Mail priority service called "Special
Delivery" which is faster and more reliable than 1st Class
post.. All balloons will be dispatched on the working day before
the delivery date which has been chosen by the customer. If
no delivery is attempted, by the Royal Mail, on the chosen delivery
date, NA will offer the Customer a voucher for £13.50.
The offer of a voucher is providing the balloon is not delayed
by industrial action by Post Office Counters, Royal Mail or
other parties involved within the Royal Mail delivery system
or if the delivery is delayed due to adverse weather (e.g. heavy
snow, floods, etc.).
- Please
note that there are certain parts of Scotland and the Channel
Islands, where delivery by the Royal Mail® takes two to
three days. If in doubt please telephone us on 0800 096 1001
to confirm the exact delivery period.
- NA can
not be held responsible for delays or for balloons that are
lost in internal postal systems once the balloon has been delivered
by the Royal Mail to the delivery address provided by the customer.
- Vouchers
for late delivery will not be issued where the recipient has
been made aware of an attempted delivery by the Royal Mail and
they decide not to immediately collect the parcel from their
local sorting
office
REFUNDS
- Refunds
will only be issued for damaged goods or goods lost in transit.
No refunds will be issued for late delivery.
- If upon
arrival the balloon is damaged, NA must be notified in writing,
by the customer, within 5 days of the balloon being dispatched.
All packaging
and contents of the parcel must be kept. Failure to keep these
may result in a claim being rejected. NA will send a letter
to the recipient asking for the balloon to be returned to NA
so the damage can be inspected and check that the balloon was
dispatched by NA (All balloons dispatched are security coded
to enable identification upon return). If an additional gift
has been included with the balloon and only the balloon is damaged,
only a partial refund for the cost of the balloon will be given.
- A contract
between the customer and NA will only be completed upon payment
being authorised by the relevant company NA use to process the
customer's chosen method of payment.

RIGHTS AS A CONSUMER
